Anyone can use these links to report an incident of sexual misconduct, discrimination, or harassment. The form alone does not begin an investigation. This form is a way for you to tell us about what you experienced or witnessed and for you to learn about supportive measures and resolution options.

Anonymous Reports
You may submit the above reports anonymously by leaving the name and contact information fields blank. Anonymous reports, however, may limit the University’s ability to respond effectively to the submitted information. Furthermore, while the University will not attempt to trace anonymous reports to an individual user, a court may compel the production of log-in and user data from which certain identifying information later could be obtained.
What Happens After a Report is Submitted
Upon receipt of a report of prohibited conduct, a staff member will contact the Complainant, if identified, to provide information about supportive measures, discuss the Complainant's wishes regarding supportive measures, and explain the process of filing a formal complaint.
The information provided in this report, including names, will be shared only with the UND employees who need to know in order to assist in providing support or resolution, although in certain situations some or all of the information must be shared with local law enforcement. Disclosures are protected by privacy laws that apply to a student’s education records, law enforcement investigative records, and North Dakota law related to Title IX records, as applicable. Complainants always have the right to choose whether to participate in any University or law enforcement processes.

Grievance Procedure Summary
The following is a brief summary of the grievance procedure. Please review the procedures for Title IX Sexual Misconduct Response (for sexual harassment and violence as defined by Title IX), Sexual Misconduct Response (for sexual harassment and violence outside of Title IX), and Discrimination and Harassment Response Procedures (for other types of discrimination and harassment, including retaliation) for the complete procedure.
A Civil Rights & Title IX staff member will contact the complainant within three business days to discuss the grievance process and potential supportive measures. The Assistant Vice President for Civil Rights & Title IX, or designee, will perform an initial assessment of the complaint to determine whether (1) jurisdiction exists and (2) the complaint alleges facts, if proven to be true, that state a potential violation of the applicable policy. If either of those elements are not met, the complainant will be notified that their complaint, or specific allegations within the complaint, are dismissed.
If the complaint is accepted, an investigation will begin. Following the investigation, the complainant and respondent will receive a copy of the investigative report and will have an opportunity to review and comment on the report. A hearing (for Title IX Sexual Misconduct and Sexual Misconduct complaints) or pre-determination conference (for Discrimination and Harassment complaints) will then be scheduled with the assigned decision-maker, who will be free from bias and conflict of interest, and will not be the investigator. Following the hearing or pre-determination conference, the decision-maker will have 30 calendar days to issue their written determination. UND aims to issue a written determination within 120 calendar days of receiving a formal complaint. However, temporary delays or extensions may occur.
Both parties are entitled to appeal the determination. The appeal must be in writing, directed to the Civil Rights & Title IX Resolutions Manager, within ten calendar days of the date the University provided the written determination to the parties. If the appeal is timely filed and states an allowable basis for appeal, the non-appealing party will be notified of the appeal and will have an opportunity to provide a written response. The appeal documents, investigative report, and written determination will be provided to the appeal decision-maker, who will be free of bias and conflict of interest and will not be the investigator or initial decision-maker. The appeal decision-maker will have 30 calendar days to issue their written decision.
Confidential Resources
The University also offers access to confidential resources for students and employees who are unsure about whether to report prohibited conduct or are seeking counseling or other emotional support in addition to (or without) making a report to the University.
Students and employees are entitled to receive information, assistance, and a broad range of supportive measures regardless of whether they choose to file a formal complaint or pursue criminal resolution.
